Terms of Service

Effective: April 4, 2026

1. Acceptance of Terms

By accessing or using FleetGuard (“the Service”), operated by DailyVault LLC, a New Jersey limited liability company located in Hackensack, New Jersey, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and DailyVault LLC.

2. Service Description

FleetGuard is a software-as-a-service (SaaS) platform that provides DOT compliance tracking, driver document management, automated SMS and email alerts, invoice generation, AI-powered document reading, audit simulation, and related fleet management tools for trucking companies, fleet owners, independent owner-operators, dispatchers, and managers.

The Service uses artificial intelligence (Anthropic Claude API) to read and extract data from uploaded documents, including but not limited to commercial driver's licenses (CDL), medical certificates, insurance documents, vehicle registrations, and DOT inspection reports.

IMPORTANT: FleetGuard is an organizational and tracking tool ONLY. It does not constitute legal, regulatory, or compliance advice. It does not guarantee compliance with any federal, state, or local regulation. Users are solely and entirely responsible for their own DOT compliance, FMCSA compliance, and adherence to all applicable transportation laws and regulations.

3. Regulatory Disclaimer

The Service is designed to assist with tracking and organizing compliance-related documents and deadlines. The Service does NOT replace, supplement, or serve as a substitute for professional legal counsel, compliance officers, or direct consultation with regulatory agencies including but not limited to:

  • The Federal Motor Carrier Safety Administration (FMCSA)
  • The U.S. Department of Transportation (DOT)
  • State-level Departments of Motor Vehicles (DMV) and transportation authorities
  • The Pipeline and Hazardous Materials Safety Administration (PHMSA)

The Service does not account for all differences in regulations across states, municipalities, or jurisdictions. Users operating in multiple states are responsible for understanding and complying with the specific requirements of each jurisdiction in which they operate.

4. Vehicle and CDL Coverage

The Service is designed to support compliance tracking for all types of commercial motor vehicles (CMVs) as defined under 49 CFR 390.5, including but not limited to:

  • Tractor-trailers and semi-trucks
  • Straight trucks and box trucks
  • Step vans and delivery vehicles
  • Flatbed trucks
  • Tanker vehicles
  • Refrigerated trucks
  • Light-duty commercial vehicles
  • Heavy-duty commercial vehicles (GVWR over 26,001 lbs)
  • Buses and passenger carriers used in commerce
  • Any other vehicle used in interstate or intrastate commerce

The Service supports tracking for drivers holding CDL Class A, Class B, and Class C licenses, as well as drivers with endorsements including but not limited to Hazmat (H), Tanker (N), Passenger (P), School Bus (S), Double/Triple Trailers (T), and combination endorsements.

The Service applies equally to for-hire carriers, private fleets, and owner-operators. However, the Service does not automatically adjust compliance requirements based on vehicle type, GVWR, CDL class, or endorsements. Users are responsible for understanding the specific compliance obligations that apply to their vehicles, drivers, and operations.

5. User Accounts

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. DailyVault LLC is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

6. User Responsibility

You acknowledge and agree that:

  • You are solely responsible for maintaining DOT, FMCSA, and all other regulatory compliance for your fleet, drivers, and vehicles.
  • You must independently verify all data displayed in the Service, including expiration dates, compliance scores, document statuses, and AI-extracted information.
  • You must not rely solely on the Service for any compliance decision, audit preparation, or regulatory filing.
  • You are responsible for the accuracy of all data you enter into the Service, including driver information, vehicle details, and document metadata.
  • You are responsible for ensuring that all documents uploaded to the Service are authentic, accurate, and current.
  • Failure to receive or act upon a notification, alert, or reminder from the Service does not relieve you of any compliance obligation.

7. AI-Generated Content

The Service uses artificial intelligence (including Anthropic Claude API) to extract data from uploaded documents, generate audit risk identification reports, classify document types, calculate compliance readiness scores, and provide support chat responses. AI-generated content, including but not limited to audit simulations, document classifications, compliance scores, and compliance recommendations, is provided for informational purposes only. Such content may contain errors, omissions, or outdated information. You acknowledge and agree that:

  • AI-generated content does not constitute professional compliance consulting, legal advice, or an official regulatory determination.
  • AI-generated audit risk reports are risk identification tools, not determinations of compliance. They do not represent actual DOT audit results, predictions, or guarantees.
  • AI-generated compliance scores reflect only the documents and records currently stored in FleetGuard. They do not represent your complete DOT compliance status. Areas not tracked by FleetGuard (including but not limited to Hours of Service, operating authority, and ELD compliance) are not reflected in the score.
  • Estimated fine ranges cited in audit reports are based on publicly available FMCSA data and may not reflect the actual penalties that would be assessed in your specific case.
  • AI-generated document classifications and extracted data (document type, expiration date, holder name) are assistive and may require verification. You are responsible for confirming the accuracy of all AI-extracted information.
  • You agree not to rely solely on AI-generated content for compliance decisions.
  • DailyVault LLC is not liable for any errors, omissions, or inaccuracies in AI-generated outputs, or for any actions taken or not taken based on AI-generated content.

8. Notification and Alert Disclaimer

The Service provides automated SMS, email, and in-app notifications for document expirations and compliance deadlines. You acknowledge and agree that:

  • Notifications may be delayed, undelivered, or fail due to SMS carrier issues, system errors, server downtime, third-party service outages, or other technical issues beyond our control.
  • DailyVault LLC does not guarantee the delivery, timing, or accuracy of any notification or alert.
  • Failure to receive a notification does not constitute grounds for any claim against DailyVault LLC.
  • You are responsible for independently monitoring your compliance deadlines regardless of whether you receive notifications from the Service.

9. Billing and Payments

Paid plans are billed on a monthly or annual basis through Stripe. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Free trial accounts automatically convert to the Free plan (1 driver) after 14 days unless a paid plan is selected. Downgrading may result in loss of access to features available only on higher-tier plans.

10. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) upload false, fraudulent, or misleading documents; (c) attempt to gain unauthorized access to the Service or its related systems; (d) interfere with or disrupt the Service; (e) resell or redistribute the Service without written consent; (f) use the Service to circumvent or avoid compliance obligations; (g) submit documents on behalf of individuals who have not consented to their information being processed.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. DAILYVAULT LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

DAILYVAULT LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA DISPLAYED IN THE SERVICE, INCLUDING BUT NOT LIMITED TO COMPLIANCE SCORES, DOCUMENT STATUSES, EXPIRATION DATES, AI-EXTRACTED DATA, OR AUDIT SIMULATION RESULTS.

DAILYVAULT LLC DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC COMPLIANCE REQUIREMENTS OR THAT THE SERVICE COVERS ALL APPLICABLE FEDERAL, STATE, OR LOCAL REGULATIONS FOR YOUR SPECIFIC VEHICLES, DRIVERS, OR OPERATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAILYVAULT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, REVENUE, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF DAILYVAULT LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, DAILYVAULT LLC SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: (A) DOT FINES, PENALTIES, OR ENFORCEMENT ACTIONS; (B) FMCSA VIOLATIONS OR OUT-OF-SERVICE ORDERS; (C) MISSED COMPLIANCE DEADLINES; (D) GROUNDED DRIVERS OR VEHICLES; (E) FAILED AUDITS; (F) NOTIFICATION DELAYS OR FAILURES; (G) AI EXTRACTION ERRORS; OR (H) ANY REGULATORY CONSEQUENCE RESULTING FROM RELIANCE ON THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO DAILYVAULT LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You are solely responsible for the accuracy, completeness, and timeliness of all data entered into FleetGuard, including but not limited to driver information, document uploads, vehicle records, drug testing records, accident register entries, and company filings. FleetGuard provides tools to organize and track this data; it does not independently verify or validate the information you provide.

You agree to indemnify, defend, and hold harmless DailyVault LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any DOT or FMCSA fine, penalty, or enforcement action related to your fleet, drivers, or vehicles; (e) any claim by a third party (including drivers, employees, or regulatory agencies) related to your use of the Service; (f) any data you upload, enter, or transmit through the Service; (g) inaccurate, incomplete, or untimely data entry; (h) reliance on AI-generated content for compliance decisions.

14. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Bergen County, New Jersey. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST DAILYVAULT LLC.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court in Bergen County, New Jersey, for disputes within the court's jurisdictional limits.

15. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the billing portal or by contacting us. We reserve the right to suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your right to access the Service ceases immediately. We may retain your data for up to 90 days following termination, after which it will be permanently deleted unless retention is required by law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws provisions. To the extent litigation is permitted under these Terms, any legal action shall be subject to the exclusive jurisdiction of the state and federal courts located in Bergen County, New Jersey.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. AI Support Chat

The Service includes an AI-powered support chat feature that provides automated responses to product-related questions. You acknowledge and agree that:

  • Support chat responses are AI-generated and may be incomplete, inaccurate, or outdated.
  • The support chat is designed to assist with FleetGuard product navigation and usage only.
  • The support chat does not provide legal, regulatory, compliance, tax, or professional advice of any kind.
  • You must not rely on support chat responses for compliance decisions, regulatory filings, or legal interpretations.
  • Support chat conversations may be logged for quality improvement and support purposes.
  • Do not submit sensitive personal information (Social Security numbers, bank account details) in the support chat.

20. Data Security Commitments

DailyVault LLC implements the following technical, administrative, and physical safeguards to protect Customer Data, as further described in our Information Security Statement:

  • Encryption in transit: All data transmitted between your browser and the Service is encrypted using TLS 1.2 or higher (HTTPS).
  • Encryption at rest: Customer documents are stored in Cloudflare R2 object storage with AES-256 encryption at rest. Passwords are hashed using bcrypt and never stored in plain text.
  • Access control: Authentication uses JSON Web Tokens (JWT) with expiration. Multi-user access supports role-based permissions (Owner, Admin, Viewer). Document retrieval uses signed URLs with 15-minute expiration — no permanent public document links.
  • Tenant isolation: All database queries filter by company identifier. Users can only access their own company's data. Document storage paths are organized by company ID.
  • Audit logging: Every document view, download, upload, deletion, and data modification is logged with user ID and timestamp for security review.
  • Abuse prevention: Rate limiting is applied to authentication endpoints (5 registrations/minute, 10 logins/minute per IP) and to AI and usage-sensitive endpoints. Per-plan monthly usage limits prevent abuse of expensive operations.
  • Input validation: All user input is validated against injection attacks (SQL, XSS, file type, MIME, size).
  • Error monitoring: Application errors may be monitored in real-time to identify security incidents.

DailyVault LLC does not currently hold SOC 2 Type I or Type II, ISO 27001, or PCI DSS certifications. Our payment processor (Stripe) is PCI DSS Level 1 certified. Our cloud object storage provider (Cloudflare R2) is SOC 2 Type II certified. DailyVault LLC is actively working toward SOC 2 Type I certification as our customer base grows.

21. Customer Data Ownership

As between you and DailyVault LLC, you retain all right, title, and interest in and to any data you upload, enter, or otherwise submit to the Service (“Customer Data”), including but not limited to driver information, vehicle information, compliance documents, and company records. DailyVault LLC does not acquire ownership of Customer Data.

You grant DailyVault LLC a limited license to access, process, store, reproduce, and transmit Customer Data solely as necessary to: (a) provide and operate the Service; (b) perform the functions you request through the Service; (c) comply with applicable law; and (d) enforce these Terms.

DailyVault LLC may use anonymized, aggregated, or de-identified data derived from Customer Data (“Operational Data”) for lawful business purposes including improving the Service, developing new features, and producing industry benchmarks. Operational Data does not identify you or your customers.

Upon termination of your account, DailyVault LLC will delete Customer Data within 90 days, except where retention is required by law or for legitimate accounting/billing purposes. You may export your Customer Data at any time using the built-in export feature.

22. Subprocessors

DailyVault LLC uses the following third-party service providers to operate the Service. These subprocessors are contractually bound to maintain confidentiality and process Customer Data only as necessary to provide their services:

  • Render (United States) — Application hosting and managed PostgreSQL database
  • Cloudflare R2 (Global) — Document object storage (SOC 2 Type II certified)
  • Anthropic (United States) — AI document reading and analysis via Claude API. Per Anthropic's commercial terms, customer data submitted via API is not used for model training.
  • Stripe (United States) — Payment processing (PCI DSS Level 1 certified)
  • Quo / OpenPhone (United States) — SMS message delivery
  • Brevo (European Union) — Transactional email delivery
  • Sentry (United States, optional) — Application error monitoring

DailyVault LLC will provide at least thirty (30) days' advance notice of any material changes to this subprocessor list by updating these Terms and notifying you via email or through the Service.

23. Data Processing and Breach Notification

DailyVault LLC acts as a data processor when handling Customer Data on your behalf. When DailyVault LLC processes personal information that is subject to applicable data protection laws, DailyVault LLC will:

  • Process Customer Data only on your documented instructions and as necessary to provide the Service.
  • Ensure that personnel authorized to process Customer Data are subject to confidentiality obligations.
  • Implement the security measures described in Section 20.
  • Notify you without undue delay — and in any event within seventy-two (72) hours — after becoming aware of a data breach affecting your Customer Data.
  • Assist you in responding to requests from data subjects exercising rights under applicable privacy laws.
  • Return or delete Customer Data upon termination of your account, subject to legal retention requirements.

24. Customer Security Responsibilities

You are responsible for maintaining the security of your account and your Customer Authorized Users' accounts. Specifically, you agree to:

  • Use a strong, unique password for your account.
  • Never share login credentials with unauthorized parties.
  • Notify DailyVault LLC immediately of any suspected unauthorized access.
  • Review user access permissions at least annually and promptly remove access for terminated employees or users who no longer require it.
  • Use the team access feature to grant role-based access rather than sharing credentials.
  • Not upload data you do not have authority to share with DailyVault LLC.

25. Security Vulnerability Disclosure

If you discover a security vulnerability in the Service, please report it responsibly to support@docketscreen.com. DailyVault LLC commits to acknowledging vulnerability reports within forty-eight (48) hours and to working in good faith with security researchers to resolve issues. DailyVault LLC will not pursue legal action against researchers who report vulnerabilities in good faith and in compliance with responsible disclosure practices.

26. Multi-Fleet Operation Types

The Service supports multiple fleet operation types, including but not limited to CDL Commercial (DOT-regulated trucking), Non-CDL Commercial (cargo vans and delivery fleets under 10,000 lbs GVWR), Rideshare (Uber, Lyft, and similar platforms), and Rental Fleet (Turo, Getaround, and similar peer-to-peer rental platforms). You are responsible for selecting the correct operation type for each driver, vehicle, and fleet within your account. The required document checklist displayed by the Service is filtered based on the operation type you select. The accuracy of these filters is not a substitute for your own legal and regulatory verification. Requirements vary by state, by platform terms of service, and by federal regulation, and DailyVault LLC makes no representation that the filtered checklist displayed for any given operation type is legally complete for your specific jurisdiction, platform, or business model.

27. Document Requirement Exemptions

The Service permits account owners and administrators to mark specific required documents as "not applicable" for individual drivers or vehicles, with a mandatory written reason stored as part of an audit trail. By using this feature, you acknowledge and agree that:

  • Exemptions created in the Service do not waive any legal, regulatory, contractual, or platform-imposed requirement that would otherwise apply to the driver or vehicle. An exemption flagged in FleetGuard has no legal or regulatory effect outside of the Service's internal scoring.
  • You are solely responsible for the accuracy, truthfulness, and legal defensibility of any reason you provide when exempting a requirement. Providing false or misleading exemption reasons may expose you to regulatory enforcement action, platform suspension, insurance claim denial, or civil liability.
  • DailyVault LLC retains the exemption record, reason text, timestamp, and the identity of the user who created the exemption for audit trail purposes. You consent to this retention as a condition of using the exemption feature.
  • DailyVault LLC is not a party to any audit, inspection, or enforcement action that may result from your exemption decisions, and assumes no responsibility for the regulatory or legal consequences of any exemption you create.
  • If you are unsure whether a particular requirement can be exempted for a particular driver, vehicle, or fleet, you must consult a qualified compliance professional, attorney, or regulator before marking the requirement as not applicable.

28. State, City, and Platform Requirements

Compliance requirements for fleet operations vary significantly by state, city, municipality, and platform. The document types, alerts, and checklists provided by the Service are general defaults based on common federal and multi-state requirements — they are not a comprehensive list of every obligation that may apply to your specific situation. You acknowledge and agree that:

  • You are solely responsible for identifying, understanding, and complying with all federal, state, county, municipal, and platform-specific requirements applicable to your fleet, drivers, vehicles, and business model.
  • State-specific requirements vary widely. Examples include but are not limited to: rideshare insurance endorsements (California, New York, Illinois, and other states have unique requirements), state safety inspection mandates (not all states require them; those that do have different schedules and standards), state rideshare or for-hire permits (NYC TLC, California CPUC, Seattle For-Hire, Chicago Public Chauffeur, and others), state sales tax on rental income, and state-level commercial driver medical certification standards.
  • City-specific requirements vary further. Airport pickup permits, city business licenses, city commercial vehicle registrations, and other municipal requirements may apply and are not automatically tracked by the Service.
  • Platform-specific requirements change frequently. Uber, Lyft, Turo, Getaround, DoorDash, Instacart, Amazon DSP, and other platforms modify their driver, host, and vehicle requirements regularly and without notice. The Service cannot and does not track every platform's current requirements in real time.
  • International requirements are not supported. The Service is designed for use within the United States. Compliance requirements outside the United States are entirely the user's responsibility.
  • You must verify current requirements with authoritative sources — the relevant state DMV, state department of transportation, FMCSA, city clerk, platform operator, licensed compliance consultant, or attorney — before relying on any FleetGuard output for regulatory purposes.

DailyVault LLC makes no representation and provides no warranty that the Service's default document checklists, alerts, or operation-type templates are legally complete, accurate, or current for your jurisdiction or platform. The Service is an organizational tool, not a regulatory interpretation service.

29. Rideshare and Rental Fleet Operators

Users who operate rideshare (Uber, Lyft, and similar platforms) or rental fleet (Turo, Getaround, and similar peer-to-peer vehicle rental platforms) businesses acknowledge additional responsibilities beyond those applicable to traditional CDL commercial carriers:

  • Personal auto insurance does not cover rideshare activity in most cases. Standard personal auto policies typically contain exclusions for commercial use, including rideshare driving. You must confirm with your insurance carrier whether your policy includes a rideshare endorsement or whether you need a separate commercial or rideshare-specific policy. FleetGuard does not verify insurance coverage adequacy.
  • Financed or leased vehicles used for rental or commercial purposes may violate your loan or lease agreement. Most auto lenders and lessors prohibit commercial or peer-to-peer rental use without written permission. Doing so may void your loan, void your insurance, and expose you to financial liability. FleetGuard does not verify lender or lessor approval.
  • Platform-specific background checks, vehicle inspections, and approval processes are controlled by the platform operator (Uber, Lyft, Turo, etc.), not by FleetGuard. Tracking platform-issued documents in FleetGuard does not substitute for meeting the platform's current requirements, and approval status can be revoked by the platform at any time.
  • Tax obligations for rideshare and rental income (federal, state, and local) are the user's responsibility. Rental income may be subject to state sales tax in some jurisdictions, and both rideshare and rental income are typically subject to federal self-employment tax. FleetGuard does not provide tax advice or calculate tax liability.
  • Airport pickup permits, city commercial vehicle permits, and for-hire permits are required in many jurisdictions before legally operating rideshare or rental fleet vehicles. These permits are not automatically tracked and are the user's responsibility to obtain and maintain.

Rideshare and rental fleet operators bear the same responsibility as CDL commercial operators to consult their own attorneys, insurance agents, tax advisors, and platform representatives to ensure full compliance with all applicable laws and platform terms of service.

30. Personal Driver Plan

The Service offers a “Personal” plan tier (currently $9.99/month or $99/year) designed for individual drivers — a single person who wants to track their own driver's license, personal auto insurance, registration, state inspection, emissions, and vehicle maintenance reminders. The Personal plan is limited to one driver and one vehicle. You acknowledge and agree that:

  • The Personal plan is an organizational and reminder tool for individual use only. It is not intended for fleet operators, commercial carriers, rideshare operators, or rental fleet hosts. Users operating in those categories should select the Solo or higher business tier.
  • The Personal plan does not include DOT compliance features such as HOS tracking, driver qualification files, or FMCSA-required records. Personal plan users who later engage in commercial driving (for-hire carriage, rideshare, or rental fleet hosting) must upgrade and are solely responsible for maintaining all commercial compliance obligations.
  • Alerts and reminders sent to Personal plan users (SMS, email, in-app) are courtesy notifications only. Missing a reminder does not relieve you of any obligation to renew a license, insurance policy, registration, or inspection on time. You remain solely responsible for renewing your documents by their actual expiration dates regardless of whether you receive a notification.
  • Personal plan pricing, feature set, and availability are subject to change with thirty (30) days' notice. DailyVault LLC may discontinue the Personal plan or modify its limits at any time.

31. Vehicle Maintenance and State Compliance Tracking

The Service provides features to track vehicle maintenance events (oil changes, tire rotations, brake checks, and similar service), state safety inspections, emissions inspections, current mileage, and related maintenance schedules. You acknowledge and agree that:

  • Maintenance log entries, mileage readings, and service intervals stored in the Service are user-entered and are not independently verified by DailyVault LLC. The accuracy of these records is the user's sole responsibility.
  • Maintenance reminder intervals (for example, “oil change due at 5,000 miles”) are defaults and user-configurable estimates. They are not a substitute for your vehicle manufacturer's recommended maintenance schedule, your fleet maintenance policy, or any applicable DOT periodic inspection requirement under 49 CFR 396.
  • State safety inspection schedules, emissions inspection schedules, and registration renewal cycles vary by state and by vehicle type. The Service does not automatically determine the correct schedule for your jurisdiction. You are responsible for entering the correct due dates and verifying them with your state DMV or inspection authority.
  • DailyVault LLC does not perform, witness, or certify any maintenance, inspection, or repair. All references to vendors, shops, mechanics, or inspection stations in the Service are user-entered and not endorsements.
  • Estimated cost fields stored alongside maintenance records are for the user's own budgeting and planning purposes. They do not represent quotes, contracts, or commitments from any vendor, and DailyVault LLC makes no representation about their accuracy.

32. Company Records and Administrative Documents

The Service provides an Admin tab for tracking company-level records, including but not limited to LLC formation documents, EIN letters, DOT authority (MC number), general liability insurance, commercial auto insurance, workers compensation insurance, BOC-3 process agent designations, UCR registrations, IFTA licenses, IRP registrations, state business licenses, surety bonds, Heavy Vehicle Use Tax (Form 2290) records, annual report filings, and similar company obligations. The Service also supports tracking of recurring obligations such as LLC annual fees, quarterly tax filings, yard rent, subscription renewals, and broker invoice payouts. You acknowledge and agree that:

  • Company documents uploaded to the Admin tab are stored using the same security controls described in Section 20 (encrypted at rest in Cloudflare R2, accessed via signed URLs, isolated per company identifier). However, the sensitivity of these documents is the user's responsibility to assess before upload.
  • Reminders for company document expiration dates and obligation due dates are best-effort courtesy notifications. DailyVault LLC does not guarantee that a filing, renewal, or payment will be made on time, and missing a company document renewal, tax filing, or annual report is the user's sole responsibility regardless of notification status.
  • The Service does not provide legal, tax, or business formation advice. Users must consult their own attorneys, accountants, and registered agents for all decisions regarding company formation, tax obligations, authority maintenance, and filing requirements.
  • The list of supported document categories in the Admin tab is not exhaustive. Your jurisdiction, business model, and regulatory status may impose additional document requirements that the Service does not automatically track.

33. AI Document Holder Verification

The Service uses artificial intelligence to attempt to verify that the name appearing on an uploaded document (for example, a CDL or medical certificate) matches the name of the driver to whom the document is assigned in the Service. You acknowledge and agree that:

  • AI name verification is a best-effort assist feature only. It may produce false matches (approving a document that should not match) or false mismatches (flagging a legitimate document).
  • A document flagged as “name mismatch” is marked for manual review but is not automatically rejected. You remain responsible for reviewing flagged documents and confirming whether they are legitimate.
  • A document that passes AI name verification is not certified, authenticated, or validated by DailyVault LLC. You remain responsible for independently verifying the authenticity and accuracy of all documents uploaded to the Service.
  • AI name verification is not a fraud detection system, identity verification service, or substitute for formal driver qualification procedures. It does not replace the driver qualification file requirements of 49 CFR 391.

34. Bulk Document Upload

The Service permits users to upload multiple documents simultaneously through a bulk upload feature (up to ten files per request). Bulk upload results, including AI-extracted document types, expiration dates, and compliance assignments, are subject to the same AI limitations described in Section 7 (AI Disclaimer) and Section 33 (AI Document Holder Verification). You are responsible for reviewing each document that is processed in a bulk upload, verifying its AI-detected category, and correcting any misclassifications before relying on the resulting compliance status.

35. Entire Agreement

These Terms, together with the Privacy Policy and the Information Security Statement, constitute the entire agreement between you and DailyVault LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
